Javier Sánchez-Vera, member of Fide's Academic Council, accesses the Chair of Criminal Law of the Complutense University of Madrid.
On September 14, in the Hall of Degrees of the Faculty of Law of the Complutense University, before a large audience, an audition corresponding to the opposition for one of the chairs of criminal law of that Faculty took place. The only candidate for the same was Dr. Javier Sánchez-Vera y Gómez-Trelles , until now full professor at the same university.
 
The curriculum and teaching and research activity of Javier Sánchez-Vera is clearly exceptional: PhD at the University of Bonn, thesis published in Germany and then in Spanish in Spain, numerous research works, academic activity in Latin American universities. The candidate made a solid and interesting one-hour exposition on the relationships between the concepts of fraud and motivation, theoretically separated in traditional doctrine. He showed that in the way of arguing the jurisprudence, however, such a separation is, in many cases, debatable.
 
He started with the concept of intent to prevail in jurisprudence and analyzed several groups of cases in which the author's motives play a significant role in the distinction between fraud and guilt. He also severely criticized the criterion of the so-called "deliberate ignorance" to which the jurisprudence sometimes resorts to compensate for the lack of knowledge of the author and maintain, nevertheless, the willful characterization of his conduct. The members of the tribunal, chaired by Prof. Margarita Martínez Escamilla (UCM) and integrated by the professors José Miguel Zugaldía Espinar (Granada), Mercedes Pérez Manzano (UAM), Silvina Bacigalupo Saggese (UAM) and Fernando Gascón (UCM) praised the high theoretical level of the thesis presented by the candidate and highlighted the importance of their practical experience in their research.
